Hourly vs Non-Exempt Salaried Employees

Classifications

AirBridge Broadband has two different employee classifications - (1) Hourly and (2) Salary. 
All hourly employees will be governed by the employee handbook.  All non-exempt salaried employees will likewise be governed by the employee handbook except for areas that are explicitly agreed to and signed for by the employee during yearly management reviews.  
Due to the nature of our business being a 24/7 operation (much like a Labor and Delivery unit at a hospital is likewise open on nights, weekends, and holidays), we have additional expectations and responsibilities we place upon those employees who freely choose to be salaried employees.

Hourly Employees

    The employee will be paid for the total number of hours worked as accurately tracted by the employee in the employer provided timeclock app.
    The employee will be paid overtime for any hours worked in excess of 40 hours per week.
    The Holiday schedule and policy as detailed in the employee handbook will apply.
    Unless otherwise spelled out, work hours will be 8 AM until 5 PM, with a 1 hour lunch, and two 15 minute paid breaks, as coordinated with the operations manager.
    Employees may clock in once one arrives at either the assigned office or the scheduled job site.  If the job site takes longer to drive to than the assigned office, the employee will be credited for any time it takes to arrive at the job site that is greater than one’s traditional commute time.  The same rules will apply when clocking out. 
    Employees can clock in only once they are ready to work (showing up to work and eating breakfast does not count as being clocked in).   
    If all jobs are completed for the day, and there are no additional tasks left to complete, the operations manager reserves the option to send the employee home for the day.
     An hourly employee will only be expected to perform the tasks explicitly spelled out in the job description.

Non-Exempt Salaried Employees

    The employee will be paid a yearly salary amount that will be paid out in 24 deposits on a yearly basis, or bi-monthly (typically the 3rd and the 18th of the month).  
    The employee will be expected to work 40 hours per week.
    The employee will not be expected to work in excess of 40 hours per week.  Having said that, please note that this can be somewhat fluid.  Some days will be less demanding and the employee might go home early (or even arrive at work later than customary), while other days might be a bit more demanding and will require the employee to stay longer than is customary. Although the daily schedule might be somewhat fluid / flexible, what is important to note is that the employee is expected to work 40 hours per week, but NOT substantially more.  
    Non-exempt salaried employees will be paid time and a half for all hours worked in excess of 40 hours per week.  These overtime hours must be documented via the employer provided timeclock app in order to be paid out.  It is the employee’s responsibility to ensure that all hours documented in the employer provided timeclock app are recorded in real time to ensure accuracy.  
    All non-exempt salaried employees are required to use the timeclock app provided by the employer to ensure that they are not working in excess of 40 hours per week.  All non-exempt salaried employees have the option of forgoing documenting hours worked in the timeclock app if documented in writing with the operations manager, and if the employee believes it is to his or her advantage, since they are NOT working in excess of 40 hours a week.   
    An Employee’s time on the clock starts once one arrives at either the assigned office or the scheduled job site.  If the job site takes longer to drive to than the assigned office, the employee will be credited for any time it takes to arrive at the job site that is greater than one’s traditional commute time.  The same rules will apply when one is ending their time on the clock for the day.  
    Employees must arrive ready to work for the day.  Simply being at the office does not constitute being on the clock (for example, if one gets food in the morning and eats without doing any work, simply shooting the bull for a prolonged period of time, or staying after work to play on the computer while completing personal tasks). 
    While on the clock, all salaried employees are expected to be engaged in productive tasks.  If a salaried employee doesn’t have anything productive to do, it is up to them to inquire about anything additional that might need to be done (even if not within one’s job description).  Shirking will not be tolerated.  It is important that salaried employees are productive until the end of shift. 
    All salaried employees might at times be scheduled to work company holidays that are detailed in the employee handbook (as mentioned, we are a 24/7 operation).  
    In the event a salaried employee works a company holiday, this employee will be given a day off for each holiday worked as coordinated by the operations manager. 
    If a salaried employee works a company holiday, there will be no additional compensation given to the employee other than the trade of another day off.  
    This agreement on company holiday policy will explicitly override anything in the company handbook.  
    Work hours will be 8 AM until 5 PM, with a 1 hour lunch, and two 15 minute paid breaks, unless otherwise agreed to and approved by the operations manager in writing. 
     Salaried employees will NOT ONLY be responsible for performing the tasks explicitly spelled out in the job description, but will demonstrate initiative in mentoring other employees, doing jobs and tasks outside their job description, and otherwise looking out for the best interests of our customers. 
    Salaried employees will not have competing job opportunities while salaried.  If competing job opportunities interfere with priority obligations to AirBridge, an employee will be immediately switched to an hourly status.
